Mechanics Lien – Extension of Time to Enforce Lien & Notice of Credit

Within 90 days of recording a mechanics lien, contractors, subcontractors, and materials suppliers must file a lawsuit to foreclose on the lien. Claimants who miss this deadline forfeit the right to file a lien foreclosure lawsuit. In some circumstances, claimants may record a notice of credit, signed by the owner of the construction site, to extend the deadline to file a lawsuit for up to one year.
